{"id":288,"date":"2023-03-09T13:59:05","date_gmt":"2023-03-09T18:59:05","guid":{"rendered":"https:\/\/www.delandattorneys.com\/blog\/?p=288"},"modified":"2024-06-20T11:17:26","modified_gmt":"2024-06-20T16:17:26","slug":"a-way-to-cure-simple-legal-description-drafting-errors","status":"publish","type":"post","link":"https:\/\/www.delandattorneys.com\/blog\/a-way-to-cure-simple-legal-description-drafting-errors\/","title":{"rendered":"A Way To Cure Simple Legal Description Drafting Errors"},"content":{"rendered":"\n<p>The Florida Legislature has provided a way to cure scrivener\u2019s errors in legal descriptions in certain deeds without the need for filing a separate law suit to reform the document containing the error.<\/p>\n\n\n\n<p>Florida Statute 689.041 allows for the filing and recording of a \u201cCurative Notice\u201d with the Clerk of the Court to correct a legal description containing:<\/p>\n\n\n\n<p>(a) an error or omission in no more than one of the lot or block identifications of a recorded platted lot (The transposition of the lot and block identifications is considered one error);<\/p>\n\n\n\n<p>(b) an error or omission in no more than one of the unit, building, or phase identifications of a condominium or cooperative trust; or<\/p>\n\n\n\n<p>(c) an error or omission in no more than one directional designation or numerical fraction of a tract of land.<\/p>\n\n\n\n<p>The Curative Notice must be substantially in the form provided in such statute. The recording of the Curative Notice operates as a correction of the first erroneous deed and all subsequent erroneous deeds containing the same error.
